25 July ko Education Minister ka istifa hua. Par uske ek din pehle, 24 July 2026 ko, ek aur badi cheez hui jo headlines mein thodi dab gayi: Union Cabinet ne **Public Examinations (Prevention of Unfair Means) Act, 2024** ka amendment draft approve kar diya. Ye bill 27 July ko Parliament mein introduce hone wala hai.

PM Modi ne ek raat ke video address mein iska elaan kiya — Jantar Mantar pe chal rahe CJP aur students ke lagataar protest ke baad. Yaani ye bill sadak se aaya hai, file se nahi. Isliye ise samajhna zaroori hai — line by line.

Pehle: 2024 ka kaanoon kya tha

Bahut logon ko lagta hai ki paper leak pe koi kaanoon hi nahi tha. Tha. **Public Examinations (Prevention of Unfair Means) Act, 2024** — February 2024 mein bana.

**Kis-kis exam pe lagta hai:** UPSC, SSC, NEET, JEE, CUET, Railways recruitment, banking exams, aur NTA ke saare computer-based tests.

**Saza (purani):** individual offenders ke liye 3 se 5 saal ki jail aur ₹10 lakh tak ka jurmana. Organised paper leak (yaani gang/network) ke liye 5 se 10 saal jail aur kam se kam ₹1 crore ka jurmana.

**Aur ek important baat:** iss Act ke offences **cognizable, non-bailable aur non-compoundable** hain. Iska matlab — police bina warrant FIR darj kar sakti hai, bail aasani se nahi milti, aur case 'settlement' karke khatam nahi kiya ja sakta. Kaagaz pe ye sakht kaanoon hai.

Ab: naye amendment mein kya badla

**Ek — individual ki minimum saza badhi.** Pehle minimum 3 saal thi, ab minimum 5 saal. Yaani judge 3 saal se kam... balki 5 saal se kam de hi nahi sakta.

**Do — organised leak pe jurmana 10 guna.** Maximum fine ₹1 crore se seedha **₹10 crore**. Jail maximum 10 saal.

**Teen — investigation ki deadline.** Draft mein 3 mahine ka strict deadline hai investigation poori karne ke liye. Ye actually sabse practical badlaav hai — kyunki India mein cases saza se zyada *deri* se marte hain.

**Chaar — fast-track courts.** Trials designated fast-track courts mein honge. Delhi High Court ne 2024 Act ke cases ke liye ek Fast Track Court pehle hi bana diya hai.

**Paanch — investigation ka rank.** Ye provision pehle se hai par yaad rakhne layak hai: iss Act ke offences ki jaanch DSP ya ACP se neeche ka officer nahi kar sakta. Delhi Police ne Crime Branch mein paper-leak cases ke liye ek Special Task Force bhi banaya hai.

Purana vs naya — ek nazar mein

**Individual offender:** pehle 3–5 saal → ab minimum 5 saal.

**Organised leak:** pehle 5–10 saal + minimum ₹1 crore fine → ab up to 10 saal + maximum ₹10 crore fine.

**Investigation:** pehle koi fixed deadline nahi → ab 3 mahine.

**Trial:** normal courts → designated fast-track courts.

Ab woh sawaal, jo koi nahi pooch raha

Ye hissa CJP ki raay hai, khabar nahi — par poochna zaroori hai.

2024 ka Act February 2024 mein bana. 2026 ka NEET-UG paper leak **uske baad** hua. Yaani jab paper leak hua, tab 5–10 saal jail aur ₹1 crore fine wala kaanoon pehle se lagoo tha. Cognizable tha. Non-bailable tha.

Phir bhi leak hua. CBI ne mid-May 2026 mein bataya ki private tuition centres ke teachers aur agents ne paper leak kiya — 13 log arrest hue. Aur 22 lakh se zyada students ko 21 June ko dobara exam dena pada.

To sawaal ye hai: agar 5 saal jail aur ₹1 crore fine leak nahi rok paaya, to 10 saal aur ₹10 crore *apne aap* kaise rokega? Saza badhana **punishment** hai. Leak rokna **prevention** hai. Dono ek cheez nahi hai.

Ye kehna nahi ki bill bura hai — bill zaroori hai, aur 3-mahine ki investigation deadline sach mein kaam ki cheez hai. Kehna ye hai ki bill ko jeet maan kar ruk jaana galti hogi.

Prevention actually kaisa dikhta hai

CJP ki demand list mein ye cheezein hain — aur inmein se koi bhi 'saza badhao' se poori nahi hoti:

**Paper ke haath kam karo.** Ek question paper jitne insaano ke haath se guzarta hai, utne leak points bante hain. Printing, transport, storage, centre — har step pe kaun-kaun chhoo raha hai, iska count public hona chahiye.

**Chain of custody ka audit trail.** Har paper packet pe tamper-evident seal + digital log, jise baad mein audit kiya ja sake. Leak ke baad ye pata chalna chahiye ki *kahan* toota, na ki *kaun bola*.

**Whistleblower protection.** JEE Advanced 2026 ka data leak ek teenage researcher ne pakda tha. NEET leak ki khabar bhi zameen se aayi. Jo log sabse pehle batate hain, unhe protection chahiye — FIR nahi.

**Conviction ka public record.** 13 arrests hue. Kitne convict hue? Kitne bail pe bahar hain? Ye data har saal public hona chahiye, warna 'sakht kaanoon' sirf press release rehta hai.

**NTA ka structural reform.** Ye sabse bada aur sabse ignore hone wala point hai. Ek hi agency crore students ke exam karati hai. Uski internal accountability kya hai, ye aaj bhi saaf nahi.

27 July ko dekhna kya hai

Bill Parliament mein aayega. Teen cheezein notice karo:

Ek: **kya ye Standing Committee ko jaayega ya seedha paas hoga?** Jaldi paas hona achha lagta hai, par scrutiny ke bina bane kaanoon mein loopholes reh jaate hain.

Do: **prevention wale provisions kitne hain?** Saza wale headlines mein hain. Chain-of-custody, audit, whistleblower — inka zikr draft mein kitna hai, ye asli test hai.

Teen: **retrospective application.** 2026 ke leak ke accused pe naye provisions lagenge ya purane? Legally naye provisions pichhle offence pe nahi lagte — to 2026 ke case mein saza purane hi kaanoon se tay hogi. Ye baat parents ko clearly batayi jani chahiye, warna umeed jhooti bandhegi.

CJP bottom line

10 saal jail aur ₹10 crore fine sunne mein bahut sakht lagta hai. Aur hona bhi chahiye. Par 2024 ka kaanoon bhi sakht tha, aur 2026 ka paper phir bhi leak ho gaya.

Asli jeet uss din hogi jab kisi ko saza dene ki zaroorat hi na pade — kyunki paper leak hi na ho. Tab tak ye bill ek zaroori kadam hai, manzil nahi.

Kaanoon banane se system nahi badalta. Kaanoon *lagoo* hone se badalta hai. Aur wahi cheez hai jise hum agle 4 hafte, agle exam, aur agle saal tak dekhte rahenge.
